Terms and Conditions - Spark Business Edge Programme

By submitting an entry to the Spark Business Edge Programme, you agree to the following conditions:

1. Information on how to enter forms part of the terms and conditions of entry. Entry into the promotion is deemed acceptance of these terms and conditions.

2. The promoter is Spark Digital Limited, 16 Kingston St, CBD, Auckland 1010 (Spark).

Eligibility

Eligible Businesses and Applications

3. Entry is open to all New Zealand based businesses with 100+ Full Time Employees, regardless of whether they are customers of Spark or not (Eligible Business), who are seeking funding to give a little edge to their business.

a) Funding can be used for one of the following categories:

i. Equipment or capex purchase

ii. Training expenses for staff

iii. Professional membership for staff

iv. Mentoring for the business

v. Event or Conference activity

vi. Other activity deemed acceptable by the Judges

Promotion Period

4. The competition commences 9.00am on Thursday, 15 March 2018 and closes at 5:00pm on Monday, 30 April 2018 (the Promotion Period). Entries received during the Promotion Period will be eligible for funding.

Competition Entry

5. To enter, an authorised representative of a new Eligible Business must, during the Promotion Period:

a) Complete the form with valid contact details at www.spark.co.nz/edgegrant

b) Detail in 150 words or less what they would use the funding for.

6. To enter, an authorised representative of an existing Spark Customer Eligible Business must, during the Promotion Period:

a) Book a meeting with their Customer Lead to discuss future opportunities via customer lead email communications

b) Detail in 150 words or discuss with their Customer Lead what they would use the funding for.

7. All entrants agree to their entry, in full or in part, being published and attributed to them in the event that they are selected as competition winners.

8. The Eligible Business grants to Spark the right to use their entry, in whole or in part, in accordance with these terms and conditions, in any media (including banners, signage, posters, television, magazine, Internet, Facebook, Instagram, MMS, DVD or other digital or print formats) for an unlimited time for any purpose, including but not limited to publishing the entry on the Spark’s website, promoting future promotions and grants of a similar nature, and whether or not in connection with Spark’s promotions, advertising or marketing. Where any part of an entry includes personal information, Spark will obtain the consent of the relevant individual before publishing the entry. Personal information will be held by Spark in accordance with its privacy policy at www.sparkdigital.co.nz/support/privacy-policy/. You have the right to access, update and correct such information.

9. Incomplete, uncontactable, or illegible entries will be deemed invalid and will be rejected. Spark reserves the right to disqualify any entry where it reasonably suspects that such materials are prohibited by these terms and conditions, any relevant law, or are otherwise deemed inappropriate. This is at Spark’s absolute discretion and discussions will not be entered into.

10. There is a limit of one entry per contact per Eligible Business for the duration of Promotion Period. More than one person from an Eligible Business can request a call-back should they be in a different part of the Eligible Business.

11. Spark reserves the right to verify the validity of entries and Eligible Businesses and reserves the right to disqualify any Eligible Business for tampering with the entry process or for submitting an entry that is not (in the reasonable opinion of Spark) in accordance with these terms and conditions.

12. Spark is not responsible for any lost, late or misdirected entries.

Judging

13. Judges will examine all entries and in their absolute discretion, select the top 5 entries that they judge to be the best in accordance with the criteria set out in Clause

14. The final winner will be drawn at random from the 5 finalists.

15. The criteria on which entries will be judged are:

a) the extent to which the Eligible Business is seeking funding to help enhance its day-to-day business and how it will give them a little edge.

b) the extent to which the project or activity will celebrate and highlight the work the Eligible Business has been doing and help boost its profile and strength within twelve months of the grant being awarded.

c) the extent to which that little edge will enable New Zealanders get a little edge too.

16. The winner/s will be notified by phone. Spark will make reasonable attempts to contact the winner but if the winner is not able to be contacted within three attempts or is unable to redeem the prize in accordance with these terms and conditions, the prize will be reallocated to the person with the next best entry.

17. The judges’ decision is final and Spark will not enter into correspondence regarding the result.

18. Spark Business Edge Programme Grant consists of $10,000 towards the nominated project

19. The prize must be used for the benefit of the winning business and, as applicable, towards the projects and/or activities specified on the winning business’s entry form. Spark will work with the winning business to facilitate the payment for the activities or organise reimbursement of invoices incurred.

20. Key people within the winning business and key benefactors must be willing to participate in the media relations.

21. The name of the winning business’s authorised representative on the eligibility submission for each business will remain as the sole contact for the promotion. If this person leaves the winning business, it is the winning business’s responsibility to notify Spark of the change and a replacement authorised representative.

22. The funding must be taken as stated and no compensation will be payable if the winning business is unable to use the grant as stated. A grant cannot be transferred to any other business, unless agreed to by Spark. If a winning business is unable to satisfy these terms and conditions, within twelve months of the grant being awarded, it will be forfeited by the winner.

23. If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Spark and which prevents Spark from complying with these terms and conditions, Spark will not be liable for any failure to perform or delay in performing its obligations and Spark reserves the right (subject to any applicable law) to cancel, terminate or modify or suspend this promotion.

24. Spark, its related bodies corporate and their respective officers, employees, contractors and agents (Promotion Parties) will not be liable for any losses, damages, expenses, costs or personal injuries arising out of this promotion, the promotion of this promotion or the use of any funding, including but not limited to any breach of these terms and conditions, contract or tort (including negligence) and any other common law, equitable or statutory remedy (Damages) whatsoever, including but not limited to direct, indirect and consequential Damages, including Damages that cannot reasonably be considered to arise naturally and in the ordinary course of things, even if those Damages were in the contemplation of the Promotion Parties.

25. Spark, accepts no responsibility or liability for any additional costs or expenses that may be incurred by the prize winner in relation to the prize or the winner’s use of that prize.

26. Entry details remain the property of Spark. The name and photographs of the business and its members and travellers may be used for promotional purposes by Spark, unless the business otherwise notifies Spark at the time of accepting the funding. Entrants consent to Spark using any personal information collected in connection with this promotion for the purposes of facilitating the conduct of the promotion and awarding any grants.

27. Spark accepts no responsibility for any tax implications that may arise from accepting a prize. Independent financial advice should be sought.
